Business Permitting Process

The permitting process helps ensure that air quality is not significantly degraded from new or modified air pollution sources.  Sources that have the “potential to emit” (PTE) a significant amount of any regulated pollutant must obtain a permit.

In general, the permitting process begins when an applicant submits a completed Notice of Construction (NOC) application form to the NWCAA with the appropriate fees (Section 324) and adequate information to fully describe the project. 

Permits, called Orders of Approval to Construct (OAC), assure that air-contaminant sources meet the following requirements:

  • They are equipped with the best-available control technology
  • They are in compliance with all applicable emission standards
  • Their emissions will not cause or contribute to a violation of any State or National Ambient Air Quality Standards
  • Their toxic air contaminants will not create unacceptable health risks
  • Their equipment is maintained in good working order and operated in compliance with the emission standards
